These Terms of Service govern your use of builderestsoftware.com and the BUILDEREST client portal, operated by Builderest LLC ("BUILDEREST", "we", "us"). By using the site or portal you agree to these terms.

Services

BUILDEREST provides web design, software development, AI and automation, integrations and support services. The scope, timeline, price and deliverables of each engagement are defined in a written proposal or agreement accepted by the client. If a proposal conflicts with these terms, the proposal controls for that engagement.

Proposals, invoices and payment

  • Proposals are valid until the expiration date shown.
  • Invoices are due by the date stated on the invoice.
  • Work may pause if invoices become overdue.

Client responsibilities

Clients provide timely feedback, content, access and approvals needed to complete the work, and are responsible for the accuracy and rights to materials they provide.

Intellectual property

Upon full payment, the client receives ownership of the final deliverables created specifically for them, unless the proposal says otherwise. BUILDEREST retains ownership of pre-existing tools, libraries and know-how, and third-party components remain subject to their own licenses. We may showcase non-confidential work in our portfolio unless the client opts out in writing.

Portal accounts

You are responsible for keeping your login credentials secure and for activity under your account. Notify us immediately of any unauthorized use.

Acceptable use

You agree not to misuse the site or portal, attempt unauthorized access, upload malicious files, or interfere with the services.

Warranties and liability

Except as stated in a signed proposal, services are provided "as is". To the maximum extent permitted by law, BUILDEREST is not liable for indirect, incidental or consequential damages, and our total liability for any claim is limited to the amount paid for the services giving rise to the claim.

Governing law

These terms are governed by the laws of the State of Texas. Venue lies in the courts of Dallas County, Texas.

Changes

We may update these terms; the "last updated" date shows the current version.
